Justin Bryan Dickson will serve at least 2 years and 8 months behind bars for raping a 15 year old girl at a sleepover. He was in the house serving home detention.
An Adelaide man raped a teenage girl at a birthday party, then tried to take away her phone so she could not contact her mother. Justin Bryan Dickson had been on home detention bail at a house, where the sleepover party was held in April 2018.
Sentencing Dickson in the District Court on Monday, Judge Paul Muscat said the 15-year-old victim, who was a guest at the party, and two other teenage girls slept in the living room. The girl had met Dickson for the first time that afternoon, and he was also sleeping in that room.
Sometime after the victim fell asleep, she awoke to find him behind her, holding her in place by grabbing her hip. He then raped her. Panicked, she elbowed Dickson in the chest and got up, then went to the toilet to call her mother.
“She said you (Dickson) followed her to the toilet and prevented her from closing her door,” Judge Muscat said.
“She said that you were apologising to her repeatedly.”
Dickson, who was 32 years old at the time, then unsuccessfully tried to take her mobile. “She was yelling at you to leave her alone,” the judge said. Dickson fled from the house and the girl’s parents were called, who later arrived to find their daughter in a “very distressed state”.
Judge Muscat rejected any suggestion that the victim had been flirting with Dickson earlier in the evening, or that she had shown any sexual interest in him. He said the victim felt “terrified and powerless” during the rape.
Of course Dickson tried to blame his victim for her rape in the court. EVEN IF SHE DID FLIRT WITH YOU NAKED SHE WAS 15 YEARS OLD YOU MORON !
“After overcoming her feeling of shock from the crime, she experienced frequent negative thoughts,” the judge said.
“She feels humiliated and experienced anger towards you and, sadly, herself, for not being able to defend herself or stop you from raping her.”
She now suffers panic attacks and her education has been affected.
“She told the court what you did to her was the single most frightening thing she has ever experienced, and it has made her feel vulnerable,” Judge Muscat said.
“You took advantage of her vulnerability to rape her while she was asleep in an environment where she was entitled to feel safe.”
Dickson, who pleaded guilty to one count of rape, was sentenced to four years behind bars, with a non-parole period of two years, eight months. That term was added to a sentence he was already serving for serious criminal trespass and theft.
His new combined sentence is six years nine months, with a non-parole period of four years, four months. The term was backdated to May 2018. No where near enough time behind bars
